Terms of Service.

These terms govern your use of Hail Mary ("the App"), operated by Land Supply Inc, a Delaware C Corporation. By creating an account or using the App, you agree to these terms.
The App is intended for users in the United States and is not directed to individuals in the European Union or the United Kingdom.
Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) and old enough to form a binding contract to use the App. The App is not intended for children under 13.
Accounts and sign-in
You sign in with an Apple ID, Google account, or mobile phone number. You are responsible for activity that happens under your account.
SMS verification program
Program name: Hail Mary SMS Verification
Program description: When you sign in to Hail Mary using a mobile phone number, we send you a one-time verification code via SMS to confirm your identity.
Message frequency: One message per sign-in attempt. You will receive a verification code only when you actively request one within the App. We do not send marketing messages, promotions, or any other automated messages.
Message and data rates: Message and data rates may apply. Hail Mary does not charge you for SMS messages.
Carriers: Carriers are not liable for delayed or undelivered messages.
Consent: By entering your phone number and requesting a code in the App, you consent to receive a one-time SMS verification code at that number. Consent is not a condition of any purchase.
Privacy: Your mobile number is used only to deliver verification codes. We do not sell or share mobile information with third parties or affiliates for their marketing purposes. See our Privacy Policy.
Support and help: For help, reply HELP to any message you receive from us, or email hello@joinhailmary.com.
Opt-out: To stop receiving SMS messages from Hail Mary, reply STOP to any message you receive from us. You will be opted out within 24 hours and will receive a confirmation message. After opting out, you will not be able to sign in via SMS until you opt back in by entering your phone number again in the App.
Hail Mary Pro (subscriptions)
Hail Mary offers an optional auto-renewing subscription, Hail Mary Pro, that unlocks additional features. The subscription title, the length of the subscription period, and the price per period are displayed on the purchase screen before you buy. Payment is charged to your Apple ID account at confirmation of purchase. The subscription automatically renews at the same price for the same period unless you turn off auto-renew at least 24 hours before the end of the current period; your account is charged for renewal within the 24 hours before the period ends. You can manage your subscription and turn off auto-renew in your Apple ID Account Settings. Refunds, where available, are handled by Apple under its policies. By subscribing you agree to these Terms of Service and our Privacy Policy.
User content and conduct
Hail Mary lets you chat with friends ("crews"), react to messages, and share reactions during games. You are responsible for the content you post, and you grant us a license to store and display it within the App so these features can work. You agree not to:
- harass, threaten, or abuse other users;
- post unlawful, hateful, or infringing content;
- post sexually explicit, pornographic, adult, or otherwise objectionable content;
- impersonate any person or entity; or
- attempt to disrupt, overload, or reverse-engineer the service.
There is no tolerance for objectionable content or abusive behavior. You can report messages and block other users from within the App. We review reports and may remove content, and suspend or terminate accounts, that violate these terms. If you report content or another user, we may retain the reported content and related records as needed for safety, moderation, and legal compliance, even after an account is deleted.
Account deletion
You can delete your account and all associated data at any time, self-serve, from the Settings page in the App.
AI commentary
Hail Mary's in-app character ("ballbot") generates commentary, trivia, and post-game recaps about live games. This commentary is for entertainment. It is not professional sports analysis, advice, or betting guidance, and it may be inaccurate or incomplete. You may not rely on it for wagering decisions or present it as professional advice, and you may not scrape, resell, or redistribute game data or AI output.
Intellectual property
The App, including ballbot and all software, text, and graphics (other than your content and third-party data), is owned by Land Supply Inc and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the App for personal, non-commercial purposes.
Disclaimer
Hail Mary is provided "as is," without warranty of any kind. We do not guarantee the accuracy or timeliness of game data, AI commentary, or push notifications, or that the App will be uninterrupted or error-free.
Indemnification
You agree to indemnify and hold harmless Land Supply Inc and its officers, directors, and employees from any claims arising out of your content, your use of the App, or your violation of these terms.
Feedback
Any feedback or suggestions you send us are non-confidential, and we may use them without obligation to you.
Changes
We may update these terms from time to time. For material changes, we will provide reasonable advance notice through the App or by another reasonable method before the change takes effect, and we will update the "Last updated" date above. Your continued use after the effective date means you accept the updated terms. Where required by law, we will obtain your consent.
Severability; assignment; entire agreement
If any provision of these terms is unenforceable, the rest remains in effect. We may assign these terms in connection with a merger, acquisition, or sale of assets; you may not assign them. These terms and the Privacy Policy are the entire agreement between you and Land Supply Inc regarding the App.
Apple App Store terms
These terms are between you and Land Supply Inc only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App, including product-liability, legal or regulatory, or intellectual-property claims. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government prohibited-parties list. You must comply with applicable third-party agreements (for example, your wireless data plan). Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the arbitration provision below.
Dispute resolution; arbitration; class-action waiver
Please read this carefully — it affects your legal rights. Any dispute arising out of or relating to these terms or the App will be resolved by binding individual arbitration administered by JAMS or AAA under its applicable consumer rules, rather than in court, except that either party may bring an individual claim in small-claims court. You and Land Supply Inc each waive any right to a jury trial and to participate in a class, collective, or representative action. If this class-action waiver is found unenforceable, the entire arbitration provision is void. You may opt out of arbitration by emailing hello@joinhailmary.com within 30 days of first accepting these terms.
Limitation of liability
To the fullest extent permitted by law, Land Supply Inc will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) US $100. Some jurisdictions do not allow these limits, so they may not apply to you.
